Two year anti social behaviour order for 17 year old

Downland Housing Association yesterday obtained a full ASBO at Horsham Magistrates Court against Daniel Joyce aged 17 formerly of 37 Hanbury Lane, Haywards Heath. Joyce has been the subject of numerous complaints to both Downland and Sussex Police including the use of threatening behaviour towards residents, using foul and abusive language, damage to property, causing a nuisance/annoyance with a motor vehicle and a moped.

In granting the order the Magistrates said to Joyce “You have consistently indulged in Anti Social Behaviour over a considerable time. The order is necessary to protect both Downland’s tenants and the general public in Haywards Heath”

Three local residents and a police officer attended court and gave evidence as to how Joyce’s behaviour has affected them and the community as a whole. Downland obtained an interim ASBO on 23/12/04. The order obtained yesterday will run for two years and prevents Joyce from:

  1. entering the Town of Haywards Heath, Including Lindfield.
  2. using or encouraging others to use, foul, threatening, taunting or abusive language gestures or violent or disorderly behaviour in any public place In England And Wales:
  3. acting in an anti social manner, that is to say, in a manner that causes or is likely to cause harassment, alarm or distress or nuisance to one or more persons not of the same household as himself and causing harassment, alarm or distress or nuisance to anyone in England and Wales
  4. threatening to cause, attempting to cause or causing criminal damage in England And Wales:
  5. associating with and/or being in the company of, James Phago, Paul Newton and/ or James White in England and Wales
  6. entering any commercial premises from which he has already been banned whether verbally or otherwise and not to commit any offence on any commercial premises in England and Wales.

Kevin Day Area Manager for Downland Housing Association said: “I welcome the Courts decision to grant this order. Daniel Joyce has caused untold misery to the people of Haywards Heath and this order will give them the opportunity to have some peace. I hope that other youths take notice of this case and realise that they too could find themselves subject to a similar order if they choose to act in anti social manner. I would like to thank the witnesses who attended Court and Sussex Police for their continuing commitment to work in partnership with Downland Housing Association”

Inspector Chris Ball said: “This was a partnership approach and we are very grateful for the support of Downland and the local community. This is part of the local efforts to combat behaviour that causes harassment or distress to the community and we will pursue the named targets to uphold the orders. The reason we wanted to publish the orders especially that of Daniel Joyce is so that residents can report him for possible breaches. If you see Daniel Joyce in Haywards Heath or behaving in a way that breaches the order please telephone the local police in confidence.
