Downland obtains eviction warrant following family's ‘Appalling Behaviour’

Downland Housing Association obtained an eviction warrant at Haywards Heath County Court on Thursday (25 November) against a Burgess Hill woman due to persistent anti social behaviour.

Following a hearing that lasted a day and a half, the presiding judge, DJ McLoughlin described the family’s behaviour as ‘appalling’ before granting Downland a possession warrant against tenant, Carmen Bolingbroke of 25 The Hawthorns, Burgess Hill. This decision was based on a catalogue of anti social behaviour that was heard by the court and will come into effect in the New Year.

A number of witnesses told the court how the family’s behaviour has affected them and police officers from Burgess Hill also attended court to give evidence on behalf of Downland .

The Association originally obtained a suspended possession order last November against Carmen Bolingbroke following a number of incidents including an assault on another neighbour. The situation improved for a while but during the summer their behaviour rapidly deteriorated and further action had to be brought against them .

Kevin Day, Area Manager at Downland Housing Association said, “The residents of The Hawthorns have suffered a number of years’ abuse from this family and they deserve a period of calm.

“This is another example of Downland and Sussex police working together in partnership to deal with anti social behaviour and I would like to thank the residents who attended court and gave evidence in this case"
