Downland secures an indefinite anti social behaviour order

Downland Housing Association has secured what it believes to be one of the country’s first lifelong Anti Social Behaviour Orders (ASBO).

The District Judge sitting at Haywards Heath Magistrates Court heard on February 23 how Lawrence Elleker (60) formerly of 5 Windmill Avenue, Hassocks subjected his neighbour to a campaign of verbal and physical abuse.

Following the case which was brought by Downland, Mr Elleker remains banned from living at his mother’s address or even visiting that address for the rest of his natural life. He was also ordered to pay the Association's costs of £7,794.

The District Judge said he was satisfied that Mr Elleker had subjected his neighbour to a “sustained campaign of harassment” and “that he had made her life an absolute living hell by his actions”

“The decision of the Court to make a full Anti Social Behaviour Order reinforces our commitment to use all the tools available to us to tackle this type of behaviour,” said Downland Mid Sussex Area Manager, Kevin Day.

“This should act as a deterrent to others whatever their age who act anti socially as they too could find themselves in Court if they fail to behave reasonably.

“The parties concerned can now hopefully live a normal life without fear and intimidation,” he added.

The Court orders that Mr Elleker is prohibited from:

1. Engaging in conduct which causes or is likely to cause alarm, distress or harassment to others or inciting or encouraging others to do so within the Mid Sussex District Council area.

2. Engaging in behaviour which is likely to be threatening abusive or insulting to others, or encouraging or inciting to do so within the Mid Sussex District Council Area

3. Having any contact with and/or attempting to communicate with the victims of his abuse.

4. Entering or attempting to enter and remain upon any place within the area bordered in green and marked on a map.

5. Assaulting or threatening any person with violence and/or being verbally abusive towards any person within the Mid Sussex District Council area.
