Court awards injunction against abusive couple

Downland Housing Association secured an injunction today (October 26) with the power of arrest against a Burgess Hill couple who verbally abused visiting officers.

Haywards Heath County Court heard how Garry Harris and Angela Kirk, both of 35 Denham Road, Burgess Hill used threatening behaviour and abusive language to a female Downland Housing officer and then to a male officer during a further visit.

Harris had been using land owned by Downland for carrying out vehicle repairs, parking of vehicles and disposing of rubbish, all of which was against the terms of his tenancy.

A letter was sent to the house to advise them that this behaviour was unacceptable and when this was ignored, a visit was made to the property. Kirk used abusive language to the officer and when she came back with a colleague later, Kirk continued in a threatening and abusive manner and encouraged Harris to assault the male officer. This assault was not carried out.

The court issued the following injunction:

1.Not to behave in a manner, or engaging in conduct, which causes or is likely to cause nuisance, annoyance, harassment, alarm or distress to any person.

2. From using foul, abusive or insulting langauge towards or in the hearing of any person.

3. From using or threatening to use violence towards any other person

The power of arrest is attached to all 3 points on both and in addition Mr Harris has a further condition which also has the power of arrest attached and that is -

4. Not to park in or carry out repairs to any vehicles in Denham Court, Denham Road, Burgess Hill.

“We will take any steps necessary to protect our staff when carrying out their duties”, said Downland’s Kevin Day.

“Anti social behaviour in any form will not be tolerated and I hope that this sends out a clear message to the minority of people who act in this way.”
